Terms of Service

1. Acceptance of Terms

By accessing or using HostSuite ("the Platform"), operated by Hostsphere India Private Limited ("Company", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms apply to all users of the Platform, including property managers, team members, and property owners.

2. Service Description

HostSuite is a cloud-based property management system (PMS) designed for vacation rental and short-stay property operators in India. The Platform provides tools for reservation management, guest check-in and KYC, invoicing, payment tracking, task management, and team collaboration.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice to users.

3. User Accounts

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account or allow others to access it on your behalf.
• You are responsible for all activity that occurs under your account, whether or not authorised by you.
• Notify us immediately at info@hostizzy.com if you suspect unauthorised access to your account.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable Indian laws.
• Upload false, misleading, or fraudulent guest KYC documents or reservation information.
• Attempt to gain unauthorised access to any part of the Platform or other users' accounts.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Interfere with the Platform's operation, servers, or networks.
• Use the Platform to send spam, phishing messages, or unsolicited communications.

5. Payment Terms

• Subscription fees are billed monthly in advance in Indian Rupees (INR) and are non-refundable except as required by law.
• Failure to pay subscription fees may result in suspension or termination of your account.
• Prices are subject to change with 30 days' notice. Continued use of the Platform after the effective date of a price change constitutes acceptance.
• All prices are exclusive of applicable taxes (including GST). You are responsible for paying all taxes applicable to your use of the Platform.

6. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of information as described therein.

You retain ownership of all data you upload to the Platform. We process your data only as necessary to provide the service.

7. Intellectual Property

The Platform, including its software, design, logos, and content, is owned by Hostsphere India Private Limited and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for your internal business purposes.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Hostsphere India Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of or inability to use the Platform.

Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amounts paid by you to us in the three months preceding the claim.

9. Termination

You may cancel your subscription at any time from your account settings. We reserve the right to terminate or suspend your account for violation of these Terms, non-payment, or any other reason with reasonable notice.

Upon termination, you will have 30 days to export your data. After this period, your data may be permanently deleted from our systems.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
